I actually disagree in theory. I thought the advantage went towards the theme/plugin developers. Given that this is a law interpretation thing, there are valid points on both sides and it is a tough argument either way.

As you have said, people are providing more evidence that Thesis has actually copied portions of the WordPress code. Thankfully, that means that any legal action could be directed solely at the Thesis developers, and not premium plugins and themes as a whole.</description>
